A report from Florida authorities revealed that a five-year-old girl fell off a Disney Dream cruise ship in June while posing for a photo on a porthole railing at her mother’s request. The Broward County Sheriff’s Office labeled the incident as “avoidable,” occurring on the ship’s return journey from the Bahamas to Port Everglades in Fort Lauderdale. The state attorney’s report criticized the mother’s actions as “arguably negligent and irresponsible” for facilitating the photo opportunity but determined that criminal charges were not warranted.

The incident garnered global attention after the child and her father were rescued by cruise ship staff, with the dramatic rescue captured on video and shared on social media platforms like TikTok. Security footage indicated that the family was walking on deck four when the mother gestured toward the railing, leading the child to climb on it, lose her balance, and fall approximately 49 feet into the water. The father jumped in to rescue her about 45 seconds later.

After a successful rescue operation by the ship’s team, both the child and father were retrieved from the water by 11:49. The child suffered from hypothermia, while her father sustained a spine fracture. In a police interview from his hospital room, the father recounted the events, emphasizing that he did not witness the fall but responded promptly upon hearing his wife scream. The mother, on the other hand, expressed surprise at the lack of protective coverings on the ship’s windows and attributed the incident to Disney’s responsibility.

Despite the characterization of the fall as “avoidable” by authorities, no charges were pressed against the mother following a review by the Broward County State Attorney’s Office. The decision was based on the determination that while the mother’s actions were negligent, they did not meet the threshold for criminal negligence. Incidents of passengers falling overboard are rare, accounting for a minute fraction of total passengers and crew according to industry data. The report highlighted that most overboard incidents result from intentional or reckless behavior, with a low percentage of successful rescues in such cases.
