StubHub and CEO Eric Baker are facing a proposed $5 million class-action lawsuit in the U.S. for their alleged connections to major scalpers, as reported by CBC News recently. The lawsuit, filed by Louis Sanquini, a ticket buyer from New York, accuses StubHub of deceptive practices by portraying itself as a platform for fans to buy and sell tickets.
Despite StubHub’s claims of being solely a technology platform without involvement in ticket transactions, recent disclosures by Baker to the U.S. Securities and Exchange Commission revealed his association with Andro Capital, a hedge fund engaged in large-scale ticket resale on the StubHub platform.
Sanquini initiated the class action in the Southern District of New York, claiming that consumers were misled about StubHub’s neutrality. Lead counsel Kevin Steinberg emphasized the importance of honesty and transparency in dealings with consumers.
The lawsuit highlights the alleged failure of StubHub to disclose conflicts of interest while promoting itself as a fan-to-fan marketplace, leading consumers to unknowingly accept unfavorable terms. Sanquini asserts that had he known about the CEO’s financial interests and the company’s support for professional resellers, he would not have utilized StubHub to purchase tickets for events like a concert by rock band Kiss or a Major League Soccer match.
In response to inquiries, a StubHub spokesperson declined to comment on the legal matter. None of the allegations have been proven in court.
The cancellations of World Cup tickets by StubHub have drawn significant attention, with customers expressing disappointment over being denied refunds or replacement tickets despite the “FanProtect Guarantee.” This situation has triggered complaints to regulatory bodies such as the U.S. Federal Trade Commission, Canada’s Competition Bureau, Consumer Protection B.C., and the Texas Attorney General’s office.
The scrutiny surrounding StubHub’s operations underscores the growing concerns over ticket resale practices and consumer protection in the marketplace.
