A former Department of Justice employee, who threw a sandwich at a federal agent during President Donald Trump’s law enforcement initiative in Washington, was acquitted of assault charges on Thursday. The incident, captured in a viral video, turned Sean Charles Dunn into a symbol of opposition to Trump’s use of federal agents to address crime in the capital. The misdemeanor acquittal represents a setback for prosecutors who have faced criticism for their handling of cases stemming from the law enforcement surge.

During the two-day trial, Dunn’s defense team argued that the sandwich toss was a harmless gesture protected by the First Amendment and should not be considered a criminal act. Attorney Sabrina Shroff emphasized that the act of throwing a sandwich did not cause any physical harm and should not be classified as assault.

Despite the prosecution’s argument that Dunn knowingly violated the law by throwing the sandwich at a U.S. Customs and Border Protection agent, the jury ultimately found Dunn not guilty of assault. Following the verdict, Dunn expressed relief and a desire to move on with his life.

Although Dunn did not testify in court, a body camera recording captured him admitting to throwing the sandwich as a diversion tactic. The grand jury’s decision not to indict Dunn on felony assault charges led to the misdemeanor charge brought by the U.S. Attorney’s office.

Dunn’s confrontation with CBP agents, during which he hurled insults and the sandwich, was met with restraint according to the testimony of Agent Gregory Lairmore. The sandwich reportedly hit Lairmore hard enough to be felt through his vest, and he kept humorous gifts related to the incident, including a sandwich-shaped plush toy and a “felony footlong” patch.

After Dunn’s arrest, the White House released a video of armed federal agents raiding his home, leading to his rearrest. Subsequently, Dunn was terminated from his position at the Department of Justice, with claims of being targeted for political speech.

Dunn faces charges of assaulting a federal officer, with his legal team arguing for dismissal based on allegations of vindictive and selective prosecution. The case has drawn comparisons to the treatment of individuals involved in the Capitol riot on January 6, 2021, where many were convicted of felonies but later received pardons or had charges dismissed.

Overall, the outcome of Dunn’s trial reflects ongoing scrutiny of the federal intervention in law enforcement matters and the implications for free speech rights and legal accountability.
