Texas Attorney General Ken Paxton has initiated an investigation into Lululemon regarding potential usage of harmful chemicals in their clothing. However, the athletic apparel company asserts that they discontinued the use of the so-called “forever chemicals” over two years ago.

The probe, disclosed on the attorney general’s website on Monday, focuses on determining if Lululemon’s sportswear contains PFAS, also known as perfluoroalkyl and polyfluoroalkyl substances.

These persistent chemicals are difficult to degrade, and the attorney general’s office stated that the presence of PFAS in Lululemon’s products might contradict the brand’s emphasis on wellness and sustainability in its marketing.

Additionally, the attorney general’s office announced plans to scrutinize Lululemon’s “restricted substances” list, testing procedures, and supply chain practices to ensure compliance with the company’s safety standards.

Ken Paxton emphasized in a statement that Americans should not have concerns about being misled when making health-conscious decisions for themselves and their families.

Lululemon, in an email to The Associated Press on Monday, clarified that they ceased using PFAS in their merchandise after phasing out the substances in early 2024. The company noted that the chemical was utilized in a minor portion of its durable water repellent products.

Ensuring the safety of their customers is a top priority for Lululemon, stating that their products meet or surpass global regulatory and safety standards. They mandate their vendors to regularly conduct testing for restricted substances, including PFAS, through reputable third-party entities to ensure continual adherence.

Lululemon acknowledged the inquiry from the attorney general’s office and affirmed their cooperation by supplying requested documentation.

Despite the investigation, Lululemon’s stock experienced a modest decrease of less than 1% in late afternoon trading.
